END-USER LICENSE AGREEMENT IMPORTANT-READ CAREFULLY

This End-User License Agreement (”EULA”) is a legal agreement between you (either an individual or a single entity) and BlueCrestStudios, LLC. For the software accompanying this EULA, which includes computer software and associated media and printed materials, and may include “online” or electronic documentation (”SOFTWARE PRODUCT” or “SOFTWARE”).

By installing this software OR opening the sealed packet(s) OR exercising your rights to make and use copies of the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, promptly return this package to the place from which you obtained it.

Software Product License

The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.

Grant of License

BlueCrestStudios, LLC. grants to you a nonexclusive license to use this SOFTWARE and related material delivered with this SOFTWARE PRODUCT. This SOFTWARE is licensed for use on one computer at a time. You may run this SOFTWARE on as many machines as you like provided there is no possibility that it can be run on more than one machine at a time. The SOFTWARE should never be installed on the hard drive of more than one computer. If the SOFTWARE is installed on a network hard drive, access must be restricted to a single user. You agree that you will not transfer or sub-license these rights. If you use the SOFTWARE on more than one computer at a time, you must license additional copies or request a multi-user license from BlueCrestStudios, LLC. You are entitled to a 15 day demo period. After this demo period a registration fee is required for use of the application.

Copyright

All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, text, and “applets,” incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT, are owned by BlueCrestStudios, LLC. or its suppliers. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material except that you may either. (a) make one copy of the SOFTWARE PRODUCT solely for backup or archival purposes, or (b) install the SOFTWARE PRODUCT on a single computer provided you keep the original solely for backup or archival purposes.

No Liability For Consequential Damages

In no event shall BlueCrestStudios, LLC. or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if BlueCrestStudios, LLC. has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

Demo Evaluation

When you first obtain a copy of the SOFTWARE PRODUCT, you are granted an evaluation period of no more than 15 days. You are expected to use the SOFTWARE PRODUCT on your system and to thoroughly evaluate its usefulness and functionality before making a purchase. After the 30 day evaluation period, you must pay for the SOFTWARE PRODUCT according to the terms and prices discussed in the SOFTWARE PRODUCT’s documentation, or you must remove the SOFTWARE PRODUCT from your system.

Purchasing:

Purchasing will entitle you to access to the latest version of the full SOFTWARE PRODUCT, the number of software licenses purchased, product updates for the major version, and priority technical support. This license is not transferable another organization or individual. Any reproduction or redistribution of the SOFTWARE PRODUCT not in accordance with the License Agreement is prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent allowable by law. Group or site licenses are available by request. Group or site licenses are handled on a client by client basis. Updates

Product updates are provided for the major version of your purchase. Major version equates to 1.0, 2.0, 3.0, etc.

Activation

Activation is required before product is usable. Registering and activation takes place with our activations servers, to uniquely identify your software with your machine. If re-activation is needed at any time, you can contact BlueCrestStudios, LLC. technical support to assist you with this. No personal information is exchanged during the activation process.

Refunds

After purchasing the SOFTWARE PRODUCT you have 30 days to request a refund. You must contact our technical support team within 30 days of the purchase date with your refund request and reason. All refunds are granted on a case-by-case basis and after a our technical support team can not correct any problems or issues with the software. All CD sales and shipping are not refundable, as CDs are already pressed and mailed. Technical support, licensing, and updates are discontinued after the refund is granted.

Technical Support

Our technical support team withholds the right to refuse support to anyone who does not comply with requests or procedures. This includes failure to submit correct information, fraudulent registration or behavior, and any other lack of cooperation. All technical support is done through our website at www.bluecreststudios.com.

Old Version Policy and Download Protection Service

Old versions are not supported or redistributed for any reason, with the exception of the Download Protection Service available for purchase with your order. Download Protection Service allows you to download the latest version your purchased products through our Customer Portal on our website. You download will be available for life, but will be limited to the latest version of major version your purchased.

Other Restrictions

This EULA is your proof of license to exercise the rights granted herein and must be retained by you. You may not reverse engineer, de-compile, disassemble, redistribute, resell, rent, or lease any part of the SOFTWARE PRODUCT, without written permission from BlueCrestStudios, LLC.

Miscellaneous

This agreement may change from time to time, so you should check with the BlueCrestStudios, LLC. website for any current or future updates that may withdrawal or extend any part of this agreement.

If you acquired this product in the United States , this EULA is governed by the laws of the State of Indiana . If this product was acquired outside the United States, then local laws may apply.
